Hello,

I've had a read of what you've said. Your version of events sounds plausible to me and, as someone else said, why did the person not report the "assault" to the police?

If I was sat at interview with the DOM for this issue, I'd question his ability to deal with a criminal matter and ask why the police were not involved - to protect other citizens from this insanely violent postman!

Another question I've got is how did the matter come to the DOM's attention? I'm just thinking that the DO manager phone numbers are usually not too easy to get hold of. Did they go through customer services?

I wonder what the DOM's agenda is too? He should have passed the buck by saying an assault should be reported to the police. Then you would be facing court proceedings before a jury of your peers.

Keithposty is correct on this. I'm going to nitpick now but the word "assault" may well be the most misunderstood in the English vocabulary. It doesn't mean what 99% of laymen think it means (at least as far as the Law is concerned). Assaulting someone DOES NOT mean striking them, it means putting them in a position where they think they are going to be struck. It's a threat with an implied follow up. That's why you have a charge in law of assault and battery, the battery being the physical act.

I'm not suggesting you play Clever Dick and treat the Royal Mail procedures with utter contempt. But how do you physically assault someone and thereby put them in fear of being physically attacked, it's preposterous.That's quite nonsensical in legal speak. It'd be funny if your situation wasn't so fraught mate and I don't mean to make light of it.

Very best of luck, it's as big a load of bollocks as I've read in a long time. I think your chances of winning at an Employment Tribunal are probably above 75%.

how did u get on ?

meeting went ahead as planned but they changed the manager taking it 3 times during the course of the morning,
delivered the goods iv been working on for last two months and made there case look very thin.
manager has gone away to look at new evidence and told me an answer will be given by end of this week
guess there will be a couple more days of waiting for an answer.

all charges dismissed level 2 manager was i must say great took all the evidence on board and told me there was no case to answer at his level and was handing it back too the line manager that had passed it up in first place.
this shows should have been sorted by him 9 weeks ago and that i should not have had the stress of past two months.
completely convinced he wanted me sacked from the start,
i do have to have a chat about post office procedures and how to best use them and i will have too come off my duty to
avoid contact with the couple that made up this story however i still have my job,my record remains clear as no warning was given this did not go down well with the manager and as im dda i have now had to be given the easiest round in office with a 3 and a half hour span alls well that ends well.
