If I were you, and what you are saying is absolutely cosher, then I would take this to the papers and name and shame this union. Do you think the staff at Tescos would keep the shop open if it had been due to close. No chance. IMO if your father had already gone over his contracted hours, then he was quite within his rights to shut up shop. It appears now that our Union is not prepared to pay for legal actions against the employer. What chance have we got.

did you Dad receive Supervisory pay? If not he should not be in the building when a manager is not present

Sounds very harsh indeed to be sacked but I would have served the remaining customers so I can understand your manager taking action, the fact that the action was to sack him is like I said, very harsh, my advice is to appeal.

Why can you understand the manager taking any action whatsoever? The manager wasnt even there!The employee has
the right to refuse overtime! So what exactly has he h been sacked for or told off for in your case? In my office there are
are usually two working dishing out the packets etc and one usually goes to entrance when its near time to close and lock
car park gates so easier to deal with with two,

The only thing i can think off is they are trying to make the 30 min flexing rule stick and there are area reps who
have made local agreements on this but OT is OT and sorry massa cant shake that tree.

If your dad hasn't personally signed an opt out or an agreement to stay to serve all customers with his own hand then there is no way this sacking will stand up in an employment tribunal.

Royal Mail's Flexibility is OPTIONAL for this reason - the law says you cannot be forced to work OT ie do 30min flexibility. No CWU agreement local or national over-rides employment law either.

If they sacked him for being rude to customers it's different but if it was for shutting up shop they will loose in court under a basic principle of employment law.

I presume this same manager will expect to fly with a low cost airline - and arrive 30 minutes late and expect to fly? I don't think so.

Anyway, Christmas last year and it's nearly 20 mins over closing up time, my dad is by himself and the Caller's Office is still queued out the door with people still coming. He decides to inform the customers he's locking up, gets them to leave and locks the door. The next day he is suspended and a week later dismissed. He was never told he had to keep it open as long as their were customers.

So what was the reason stated for his dismissal?

Good in theory but as it was just after christmas when he was dismissed he's wayyyyyyyyy out of time to apply to a tribunal.

something dont add up ??? he shouldnt have been on his own. he shouldnt have worked over his hours. he shouldnt have got the sack over this. he should have phoned his manager up on the day but still sacking him for this ?? as for the press, wopee do. wont get him his job back

To make myself clear: The majority of Royal Mail managers are ill equipped to be managers and nearly always make rash and wrong decisions, hence I understand why managers make these decisions when obviously in this case advice should have been given for future reference.

Thats an unbelievable decision by both royal mail and the cwu. So much for your caring sharing employer? as for the union surely this needs investigated and a strong case put together to have this man reinstated, if not then hang your heads and shame. Name and shame those within the union who refused to help your father on such a clear cut case, cause none of them will ever get my vote if standing for the pec again. Looking forward to your reply.

Even more reason for u to go to the press. Dig out the paperwork and fight on for your father. I know the timing isn't great but personally I would fight them all the way on this one. Sorry but it's sickening.
