B/H entitlement if on sick leave ?

was signed offfor a week from mon ,return to work was tues on sick line from doc as obviuosly cdnt go back on the monday holiday ..surely they cant take the monday as a sick day ? feeling im beein shafted .

did you ring in as "fit to return"?

My manager hasn't in the past, and TBH if you are returning on the next working day,and there is a holiday or day off in between, it is always advisable to phone the office and advise them. That way your last sick day will be the day you rang in.

However, if they have counted Monday as a sick day then you are due a day back in lieu. Might be worth a try and waving the EU ruling under their nose should help.

Ah - next time they ask you that question it should always be the truth, and if the truth is -

"Well I would have been Okay to work tomorrow, but its my day off (or bank holiday etc), so I will be in on Tuesday"

tell them that.

If your post is accurate they have probably taken that as you think you'll be sick till you return to work, sneaky of them, but within the rules.
