well going by what you,re saying there mate, if its suitability for the task rather than seniority, then whats to stop them saying, 'we,re bringing in six 20hr contracts, and we,re shifting 3 full time duties to another office. even if these 3 full time duties have 25/30 years each in service. this dom is doing wtf he wants. and the rep seems to be going along with it. if he,s allowed to overrule seniority in this way, then he could do JUST THAT with all the full time duties. then a part time office run on overtime would be the eventual outcome.
Your DOM would need to find a nearby office with the capacity to take your full-time staff, so although your scenario is there to try to over emphasise your point, it'll never be a reality. Your local Rep should be working to find a compromise with the Manager on how best to staff the duties in the office using its available manpower and working hours. In the above scenario with no compromise achieved I'd applaud the Rep for at least managing to keep the existing full time staff full time, which is a long term goal of the union.
You do need to understand one thing however, seniority is not being overruled. The law does not accept that a company can base all of its decisions regarding their staff on their seniority level. Do you honestly think that an incapable colleague should always receive preference over a capable one who started on the same day as them but who is younger. Seniority can be used for things such as preference over duty selection from a set of similar skilled duties, but not for these sort of things.
