I am not a union rep but I have had a lot of success using the grievance procedure. I have won cases for my workmates where senior union officials have failed. It would be a pleasure to help you give your managers a 'cucumber' if they deserve it.
I like the grievance procedure because it is the shortest route to outside justice, e.g. an Employment Tribunal.
Basic principles to follow when using the Grievance Procedure:
1. Only make one point per grievance. Aim to use the least amount of words required to get your point across. Make sure that there are no ambiguities. Management love to dispute the interpretation.
2. Stick to the time limits. This is a race to tribunal. If you allow them extra time, they will use it to brief lawyers, attack you from a different direction, change staff etc.
3. Avoid face to face meetings at all costs. The purpose of these meetings is to get you to speak and the more you say, the more material they have got to dispute the interpretation of. I have also been made verbal promises in meetings that have subsequently been withdrawn. It is an intimidating experience confronting a manager who has power over you and the meetings have been included in this procedure as a deterrent. Face to face meetings are not compulsory and you can politely decline to attend if you feel your grievance is straight forward. Always give them the option to write to you if they require clarification of any points in your grievance.

Yep, meeting went as I expected, Stage 1 issued.
Minimal reference mentioned to an onging problem, caused by AOD. AOD was recorded/accepted as "Injury at Work" by DSS/DWP.
NOT mentioned were 2 OTHER AOD's, one again confirmed by DSS/DWP, causing similar injury problems etc.
Medical experts observations/opinions/conclusions were not looked at, mentioned or investigated fully.
If they had been paid the courtesy they deserved, it would be obvious that without the AOD's, I would not now be in this position.
The decision was taken on "feeling" not Mitigating Circumstance and Medical Facts.
Yes, my sickness did come within the timescale they use, BUT, it was only as a direct result of AOD's consequences etc.
No AOD's, no sickness...
I have undergone all the necessary rehab, physio, work practices and other activities to recover previous levels of fitness/activity.
Currently doing all tasks, walks, deliveries and activities set by managers.
So, I'll get on the case Re; Grievenace Procedure, and give copies to CWU Local Rep, CWU Regional Rep, Manager, Regional Manager and Pool Street.
Anyone got the FULL ADDRESS of the Pool Street gaf? Ta!

You should not have had a stage 1 issued as they can't count AOD's. So if you are doing a Grievenace Case thats fair enough. At stage 1 of a Grievenace Case you don't need to send that off. Your Rep should know the proedure. I do hope the rep has been on the correct courses, I know that might sound daft but there are offices with "so called reps" in who have had no training at all. There the sort managers love. Hope you sort this out.

Hey Mr Sid...What happened was that the AOD'S were all pukker, but the injury out of work initiated the Stage.
If I hadn't had gone thro the AOD'S, my arguement is, I wouldn't have had the home incident. One led to the other...linked...connected...indisputable.
So, looking at the RM Rehab Process doc, there's all this, "We'll assist/help/encourage"...bend over backwards talk, which doesn't now stand up to close scrutiny.
Just talk, NO substance at all.
When you're still getting regular professional medical treatment, with appts in a few weeks and next month, HOW can a manager ignore the Basic Facts? Beats me...
Just because I wasn't at work, but on my way, doesn't mean the injuries CAUSED by the AOD's suddenly disappear/evaporate/go away.
They are there, and continue to be there, until they heal completely. I didn't ask for the AOD's, don't want them, but they are there.
So, I feel that RM have some responsibility for what has eventually transpired. No ambulance chasing, no blame/claim crap.

Yes, if the AOD's led to an accident out of work and you can link them then they should not count them. I can't understand RM, they get a decent worker one who will stick at the job and even take all the sh*t and that is still not enough. They moan when the can't get anyone to do the job then treat good ones like this. I hope you win but like I said before they stick together. I could tell you a few things that have gone off but can't take the chance of it on here, just watch your back thats all I will say.

Been thinking about it and, not sure the "procedure" would benefit me overall.
I don't wanna give in, it's too important, but...What response would it get?
Another piece of paper left to go yellow in my Personal File and nothing else. No action, no redress, no satisfaction etc.
So, I'll give it some more thought, but tending to think that I'll be banging my head against a brick wall.
Maybe there's "another" avenue I could pursue, just to ensure my dissatisfaction is recorded, so that if it has an effect on my future employment,
then it is Officially Noted somewhere.
Feels like the "No Appeal" side must go, if AODS are the cause of problems, then they should be highlighted as such, and their effect on workers taken into account.

You need to get written evidence that you disagree with a stage 1 warning being issued on account of your absence being due to accidents at work. This means that you will have a bit of ammunition to appeal against a stage 2 warning if necessary.
Fill out a stage 2 grievance form and give it to your line manager's manager. You also need to send a page of the form to HR.
Write:
" I disagree with a stage 1 warning being issued on account of my absence being due to accidents at work. Please revoke it."

Heard a few horror stories on here about No Action/No Replies being received after sending it in etc. That's waste of my time/effort...

Yeah agree, but the acccident at home was connected to AOD, but the DOM couldn't see this, until he stated, " ATOS should be involved..."
So, if this is his attitude/approach, and he DOES realise the accidents WERE connected, why issue a Stage? Power trip/control/arrogance???
