Why does the national Union not take test case under the Human Rights and Disabilty Discrimination laws. Surely it must be against the law to penalise workers for being sick.?

After 4 weeks of waiting, today had another interview with regards to my stage 3 with an answer.
I have been given SEVEN weeks notice!!! so i guess i will appeal against their totally insane descion as atos seemed to think i wont be covered by the DDA but my doc seemed to think i am, their descion was that i have no underlying medical problem but atos said my condition would be clear within 2 years HOW stupid are these people.

Any know how long the appeal should take. thanks in advance.

Appeals length seem to vary, its best to put an employment tribunal claim in now as you only have 3 months less a day. This may also focus RM's attention to your appeal or there again it may not.

I say again make sure you put an ET claim in

My appeal was supposed to be this thursday 25/03/2010 but i decided to not appeal as i have just landed myself a job outside of Royal Mail and it is full time as opposed to the 26 hours a week that royal mail had contracted me for since 2002 with no chance of anymore hours but expected me to work over my hours and then spout the flexibility crap when they refuse to pay me ( this happens a lot to collection drivers in our office ).

You still should have appealed regardless of your new job. You would still be entitled to lost backpay if you were successful. If it's due to be Thursday, you could still go! - After I was unfairly dismissed, I got my job back plus 9 MONTHS backpay.

Oh, and just to add... at my ET, the panel were astonished to find that the absences I had that were covered with a Doctor's sicknote were 'counted' by Royal Mail - they said "If the Doctor tells him he should not work - then he should not work, the absence is not his fault".

Agree with Big Mick. Sure, i bet you`re glad to see the back of the place, but think how good it would feel for you to get a pay out from these criminals !!

TBH i wouldn't want to work for royal mail anymore, this way i havn't been dismissed by them but resigned to go to another job and it looks far better to any other future employers.
