This is just part of a long statement from the Members part of the CWU website.

Work Related Road Safety - The HSE Guidelines, "Driving at Work" & HSE Involvement - Private Cars on Delivery Case Study

Another important area covered by the consultation is that of Work related Road Safety and in terms of corporate liability the CPS consultation document opens the discussion in two very important areas under falling under this heading.



The CWU strongly supports action being taken by the CPS and the Courts against employers in respect of failures in their employer/corporate liability duties. We support the view that where appropriate employers should face charges both for 'aiding and abetting' driving offences to take place if the company has not taken specific measures to outlaw the practices leading to an offence being committed and secondly we support HSE intervention and would like to see health and safety at work act prosecutions where failures are identified in an organisations Safety Policy to control Occupational Road Risks and ensure a safe place and safe system of work in relation to the employers general duties of care to employees and people not in their employment (members of the public) where offences occur on-the-road. The HSE Guidelines, "Driving at Work", state that "health and safety law applies to on-the-road work activities as to all work activities and the risks should be effectively managed within a health and safety system however, as we know only too well - it isn't enforced!

More people are killed and injured whilst driving at work than in any other work activity with around 20 killed 200 seriously injured every week. Therefore, the CWU agrees that employers should be prosecuted along with the driver for causing death by dangerous driving where it can be shown that they have failed to properly assess and manage the risks created by their work activities on the road and also in relation to other motoring and health and safety offences on the road, for example where the employer failed to ensure that the vehicle involved was in a safe condition.



In our response we have referred to two separate case studies involving CWU Postmen who were members of the Glasgow and District Amal Branch.



The first involved Francis Goodwin a Royal Mail driver killed on 27 July 2005 after being in a collision with an ambulance being driven by a trainee ambulance driver who was subsequently convicted of causing death by careless driving but his employers escaped health and safety at work act charges in spite of the driver not having completed his standard emergency training when the HSE refused to get involved and investigate the case.



The second is the case of Delivery Postman Robert Sharp who whilst using his private car on delivery on 21 August 2001 and returning to the DO after completing his round lost control of his car at speed, mounting a pavement and hitting three girls awaiting a school bus. One died and two were seriously injured. Sharp was found guilty of causing the death by dangerous driving of one girl and guilty of seriously injuring the two other girls. He was sent to prison for 7 years. Once again, the HSE wouldn't investigate this case and therefore no consideration was given to a prosecution of the employers for breaches of the health and safety at work act. As a result of that - the practice of poorly regulated and controlled private car use on Postal delivery rounds continues around the country.

starting from next week the 23rd april our area (ST) is going to be taking part in a week of non private car use this is an innitative. thought up locally by some of our more actitive people. The local managers and area manager are trying to disrupt this by teling members that it will be classed as secondary action .They even have the guileto get in touch with HQ's to say this,the response from HQs is to carry on as Royal Mail are in breach of there own national agreement on private cars on delivery.

Please take this issue into the heart of your workplace if this is the sort of action required to disprove Royal Mails efficency savings then it will be a small price to pay for protecting full time jobs now and in the future.

by trying to stop us doing this it shows how afraid they are of us doing the job properly.

if we all stopped using cars their fuel bill would shot up they wouldnt have the vans needed to do all the pouching and drop offs. they have a huge fleet of cars all paid for by us.
