hi folks last may my dads brother passed away,MY UNCLE.i got a special leave day for his funeral.sadly a few days ago my mums brother passed away,AGAIN MY UNCLE,asked for a special leave day for the funeral next week,my DOM told me i wont get a days special leave,i will have to swap my day off,have the rules changed within a year or did my DOM make a mistake last may,by letting me have a special leave day,im a bit confused to be honest

If arranging a funeral up to one week with pay, which includes the bereavement, arranging the funeral and any other duties (This is for arranging funerals of next of kin or as an executor).
For the death of next of kin and blood relative, (spouse, civil partner, long standing unmarried relationship, child, parent, sibling) up to one week with pay (No additional week is allowed if the person is arranging the funeral).
For a more distant relative e.g. parent in law, grandparent, aunt, uncle- one day with pay.

Does special leave definitely apply on death of aunt, uncle, nephew, or niece as i had to use 2 day,s of my own leave last year. have spoken to area rep about this and his guidelines that he was given by cwu hQ differ from the one,s that i have read on here.

The special leave policy allows for up to one week with pay for the death of next of kin and blood relative, (spouse or civil partner, child, parent, sibling) and one day with pay for parent in law (or the equivalent in a civil partnership or longstanding unmarried relationship), or grandparent.
Discretion for additional time off with pay may be granted in exceptional circumstances. If the circumstances are not exceptional, any additional time off granted will be unpaid, or taken as annual leave.

Discretion for time off with pay, in circumstances where the relationship to the deceased is not covered by the above, may be granted if the circumstances are ‘truly’ exceptional.
If the circumstances are not ‘truly’ exceptional, any time off granted will be unpaid, or taken as annual leave.
Note that under the Employment Rights Act 1996 s57A, an employee has the right to take unpaid time off upon the death of a dependant to make any necessary arrangements only. The purpose of this leave is to make funeral arrangements etc and this does not give the employee a statutory right to take more than a few days off following the death of a dependant.

Last year I was refused special leave to attend my uncle's funeral but was given it to attend my mother in laws. This appears consistent with the guidelines above.
