I thought that was ILLEGAL i.e. hiring 'strikebreakers' - you need to speak to your rep ASAP Dude.

Any employment given to outside agencies (i.e other staff employed ) during any legal strike IS against the law ...See you area rep at once

This reminds me, I understand that the CWU were pursuing agencies that supplied strike breakers during the earlier IA. Does anyone have any info on the outcome or current state of affairs?

Unfortunately agency staff will be in at my place during strike. CWU supposed to be able to take the agencies supplying these to court. Whether it will is quite another matter.
Bit of a dilemma for the union really, on one hand fighting for rights for agency workers but it has to be said some of those very same people will be working on our backlog during the strike.

Thats a crackling good point,i meant to ask the union about that today,i'll try and remember tomorrow,my guess is the agency wont give a monkeys f*** and will supply all the agency staff the RM want,there are proberly plane loads of Polish workers on their way!!!!!

The Polish staff at our place have made themselves at home at our office,i think they are here for the long haul and no doubt will be under cutting us,a bit like in the building trade.

Don't be too hasty about bashing The Poles - the ones I know are sound and they invented SOLIDARITY remember? Its RM and the Agencies that are the enemy, not the people they employ. Your point about undercutting is wrong - the per hour/person rate for RM paying the agency is more than they pay you and me. They do save on Pension etc though.

What businesses are covered underthe regulations?

The regulations cover "employment businesses" and "employment agencies". The term "employment business" is used to describe what is normally called an employment agency and the term "employment agency" is used to describe recruitment consultants. To avoid further confusion, the term "employment business" is used here. The definition of "employment business" contained in the legislation is not very clear but the key identifying factor is that an employment business supplies personnel (work seekers) to a company (the hirer) in circumstances where the work seekers are controlled and governed by the hirer rather than the business which supplied them to the hirer.

No, only to the employment business.

From what I recall the agency staff were employed and directed by the agency and not the business so it lloks as if they are not an employment business so the law doesn't apply.

Perhaps this is why the CWU are having problems? Apparently ASDA used the same tactic and the GMB were stuffed.

The Poles in Liverpool and Ipswich refused to scab. It's the British we've got to watch out for this weekend.
