Investigation started into bullying Assistant DOM

Hello troops.

If you look back at my previous posts you will see management and myself have had our fair share of disagreements, arguements and conduct cases. These have all involved the same Assistant DOM everytime. I know that managers will try and put words into your mouth in fact finding interviews in the hope you slip up. I know managers are also making our daily working day an absolute struggle in the hope once again we'll trip up. However this Assistant DOM has pushed me too far this time. With reference to the link and the conduct case. I'm a town floater and the duty I was due to cover on my rota I was moved off by management. I was moved to another BIGGER walk on my rota. NOT THE ONE I WAS DUE THOUGH. I then see who the person is that is on the town walk I should of been on. And guess what? They know the duty I was moved too! I was moved for absolutely no reason other than 'entrapment'! It get's better troops! In my fact finding interview I asked the assistant DOM why I was moved? He said he would get back to me. My Rep went in a week later and asked again on my behalf why I was moved. Still no answer. I went in on Tuesday this week and demanded an answer on why I was moved. My Assistant DOM told me I was moved to give the other person to finish of their households! I said not a very valid reason to be moved but accepted it. Just outta interest I asked the other person did they indeed do any households on the day I was moved and they told me 100% no! They don't do households on a Saturday. I then went back to Assistant DOM and told him the other person didn't even do one household the day I was moved! He was speechless!! He told me a lie to my face to try and make a conduct case glue together! Bang out of order! He can not and will not give me a valid reason why I was moved duty. If I had never been moved duty the above link with the conduct case would never of happened.

So yesterday I called the Bullying and Harassment Helpline. Very helpful! I was on the phone for an hour and told the guy everything that was going on in the office! From how some people are asked to work to that stupid prep spreadsheet and others aren't! How some people take their breaks before they go out and then claim for it at the end of their duty! Basically I made the point of telling him that there is very different rules for everyone. No two people are treated the same. He could not believe what I was telling him. He told me he would get an information pack sent out to me ASAP and to fill it in. He then asked if anyone else in the office would be willing to vouch that people were being treated differently in the office by management. I said they'll be a queue mate!

Once I fill in the form and send it back can anyone tell me what happens next? I think the guy on the helpline mentioned something about an independant comapny called 'Gateway??' would then conduct an investigation into matter. They would interview all parties involved and that it should all be sorted within 28 days. Is this right? I think this is the 2nd or maybe even 3rd time this particular Assistant DOM has had an harassment case against him.

Did my Assistant DOM overstep the mark by lying to me and not giving me a valid reason why I was moved?

im exactly same mate, been in four times to manager stating i feel at breaking point,stressed etc ,oh they say well sort it out next week,,,,,,nothing ! getting moved about off my floating job ,so other people can make more money from overtime at my expense!!!!! our office is a nightmare for bullying n harrasement not just from managers!

Mate ring this number 0800 587 4777 (Bullying and Harassment Helpdesk). They'll put you in the right direction. Your managers won't do anything. It's took me a long time to realise that. But they have no choice but to take notice of me and the problems in the office now.

Hi yes once you fill the forms in and send it to "GATEWAY" it cannot be stopped, it is all dealt with from someone out of your area, ive been through it just make sure you have times, dates, and any wittness statements. make sure you have a rep with you who understands how it works , be sure its what you want be prepared for a grilling try and get a copy of the bullying & harrasment document there should be one on here somewhere. if you go for it best of luck.

Question? Are you being moved from a rest day cover duty to allow the duty holder to work his day off on OT?

no the duty holder is on hols this week,the person who is just in the door is covering the walk all week. im supposed to cover one day a week as a floater ,but this person is coming in on his day off on overtime,whilst im moved to a job i dont know.Isnt that wrong? Its bad enough duty holders doing it to me ,,,

I'm "baws-deep" in a harrasment claim with a DOM (check my other posts if you want a wee heads up) and I'm about to put in aother, due to reprisals made becuase of the first.

The whole thing is supposed to be done and dusted in about a month and a half, but I'm still waiting after nearly three. The other problem is that the investigation is not independant in real terms. It's just dealt with by another manager who isn't directly involved with the case, ie, the guy you've put the claim in against. If your management are anything like mine, they're all pretty damn close and will "Lock Shields" if they can, to protect their own.

Be on your guard with your actions and work practices. They WILL use your slightest failing (percived or real) against you.

What should happen and what happens are 2 totally different things. I have a grievance in against a manager who gave out confidential details about me to people in my office. I have done exactly what was asked of me throughout. I called the helpline and was advised by HR that a senior manager would investigate. He interviewed me in July and I have heard nothing since. I suffered harassment due to this outrageous piece of ineptitude by the manager and have been off work because, and I quote the investigating manager, " we can t guarantee your work won t be sabotaged or you won t get similar harassment, stay at home." I have heard nothing since.

I have the HR people pushing RM management to come to some finding...nothing. I have a councillor put in place by RM asking why there is no contact...... again nothing.

What i am trying to say is that yes Gateway will get involved but they will probably just appoint an 'impartial' manager to investigate. here's some tips:

1. Make sure the so called impartial manager isn't some locale line manager who is mates with your Ass. DOM

2. Make sure you have the Union involved and cone to every meeting you are asked to attend.

3. Keep a diary of your complaints, try to remember dates etc. and keep adding what you are told and what your hear. You might think some of its irrelevant but that can be decided later.

4. Keep the HR guy involved.

5. Any correspondence, either hand it to the person or better send by Special delivery. Then they cannot claim they never received it.

6. Don t back down. The one thing realise is that RM managers for some reason have been told to lie. ( I had a chat with an manager who left because he went to a massive meeting with Alan Leighton a few years back. He asked how to deal with people who had a reasonable grievance and he didn t have an answer. He told him to LIE !) :lfo

That sounds about right. I'm having problems myself, with (how can I put this politely?) a less than honest accident investigation. I can't go into details yet, as it's still ongoing (be careful of this yourselves, as they'll use anything they can against you!). But suffice to say, that it's become a very nasty situation.

Watch your backs everyone! Even when you think that you've been cleared in an investigation. You can suddenly get a decision, months later, saying the exact opposite!
