Collegue wins Tribunal, but gets 1 year serious!

A few months ago, one of my Collegues was assaulted by a manager. The RM investigation cleared the manager, who put in a counter claim. RM found in his favour again (no surprises there then! :Sick ), so my Collegue took the matter to Tribunal. Obviously my Collegue was vindicated at the Tribunal, as it was independant, rather than being done by RM managers!

That should have been the end of the matter. But it wasn't! Once the verdict was in, we were told that the manager had been disciplined. He then returned to the same Site, but just in another Department. :shock: :silenced :Sick :no no

But it gets worse! My Collegue has now recieved a 1 year serious, for "failing to show dignity and respect to the Cage Cards"!!!!! :oops: Yes that's right. He had thrown the Cage Cards up in the air, before trying to leave the Building, during the original incident!

Is it just me, or is that malicious? :hmmmm
The timing is suspicious, to say the least. And how exactly can you offend a pile of stickers, for labeling Cages?!?!?

We'll be getting disciplinary cases under B&H for cursing defective yorks and alts we're pushing next.

WTF ?RM never fail to surpass themselves , there's always something even more surreal and imbecillic round the corner .


Like a spiteful and petulant child ? , people like that should be sacked or demoted as they should not be in positions of responsibility , very unprofessonial, cowardly & vindictive . That wants leaking to the Papers via " A friend of a friend ".

The counter claim and twisting everything on it's head is typical RM to wriggle out of something is no surprise ,the orders are not to undermine local managers no matter how imbecillic .

The sort of organization that would make cardboard submarines

It seems that your colleague is being victimized because he won his case. If he wanted to he could put in a grievance stating that he is being victimised and he should not have been given a warning for the cage cards because it is part of the same incident and case which he was cleared of by the Tribunal, therefore, this is not right.

I'll suggest that to him. At the moment, he is appealing against the decision to give him the 1 year serious.

Is it malicious?..... Yes. Unfortunately this is the way R/M work now. If you want to `rock the boat or defend yourself` they will take any punitive action against you that they can. Does anyone have an answer to this sort of vindictiveness?

The ironic thing is that he could if the appeal fails, take RM to Tribunal again for detriment against legitimate Trade Union Activity ; but RM have always been defensive , autocratic and regarded themselves above the law -it's just heightened with L&C and their very regimented 70's "style" of management .

No doubt RM would spit their dummy out again ? , I guess this is all a weird way to get 90's style deference from staff and/ or this is the only way of discouraging B&H claims / grievances by closing ranks /pulling rank -put it down to pressure from on high and panic stricken idiots in charge

It tends to get silly when you go from the old school to the corporate ., problem is you get the worst of both badly handled .

ASDA works the same way , everything is dictated from the US .

Many of these managers are out of control. They have too much power, know it, and abuse the fact.

I tend to agree, on the bad ones anyway. They now have little real power as the Top down management style of AL and AC does not allow them to manage or make a difference. Therefore the ones that want to be see by the hierarchy as possible promotion material, use their few chances to stand out from the crowd, and using the disciplinary process can be seen as a good way to do this if they don't have a conscience.

Good point. The dictatorial style that RM is currently run is odious in the extreme. But these managers are sweetened by bonuses and it seems many of them comprimise what they really believe because of this. RM has always been run in terms of what it gives to communities and society. These values may be now in decline but this country is worse for it because what is replacing these decent values are ones based on greed and profits. The bonuses these top managers receive for failure are immoral especially when our pension scheme is in such a mess.

I would love to know how many cases RM have losted at an Employment Tribunal and how many posties take RM to a Tribunal each year because I think that the number is very high.
