Advice on seniority

Brief outline......a duty became vacant in January 2016 it is still vacant as of Oct 2016 someone has been on & off that duty covering it. I asked my manager back in July if i could go on the 'vacant' duty, but now he informs me that because 'someone' has been on that round for over 6 months they cant take him off it. I am senior to this person. Is this right?

in a word no (assuming it's a regular duty with no specific skills required)
A duty can remain vacant for up to 6 months, and then MUST be advertised, and given to the most senior individual who has applied for it.
Just because someone has been covering it for a while doesn't make it theirs.

is there anything 'written' to back this up? Its a normal duty nothing specific, and it hasnt been advertised even though its been longer than 6 months.

Ring up the Area Union Rep and let him know. Happened recently in my DO. The Area Rep told our DOM, "You should have advertised it within 6 months". He hadn't so it went up on the board. Decided on Seniority. One upset member of "DOMs Chosen Few" who had been doing the duty for 12 months and thought he's Bucked the System and got himself a Regular Duty (in front of those that should have been offered it)

The Moral of this story is: Use Royal Mails procedures against them ... when you can. They can't argue with their own rules!

Spoke to my manager who said 'he' has been doing it 6 months so 'he' is staying on it. I quoted The Way Forward agreement but that got ignored so DOM said i have to put in a Grievance. The Union Rep is also supporting the DOM in his decision.

What sort of Union rep is that? f***ing idiot.
Put a grievance in and also speak to the area rep and tell him unless procedure is followed the correct way you will go as high as you can.
Do not accept this bull s**t.

Off on a tangent slightly, but can a vacant duty be allocated by interview and not seniority?

There are some specialist duties that can be allocated on suitability and bypass seniority to an extent.
Can't remember what they are though as other than WPC we don't have any in our office. (Not technically a duty but still won on interview only)

In our office the callers office job goes on suitability rather than senority

So if the duty went up on the board, how long would it have to be advertised for?
