Needed a operation to continue to work...

Post by P739 »

Was off for 3 months after a shoulder operation I was in so much pain for 4 years with it..Now getting pulled for my attendance what is it called when you have time off for the operation so you could continue to work?..Was told a while back but forgot

It would have been known to management that in some point in time you would require an operation for your shoulder for corrective surgery and if successful would allow you to return to work and enable you to complete the workload that your duty entails.
The issuing of stage warnings in the attendance procedure is not mandatory if mitigating circumstances can be shown.
In your case your absence was expected for corrective surgery and with a good rep in attendance at your interview this should be challenged and hopefully waived.

i was 4 months off after corrective surgery and was still given a stage 1, and then reading the clownshoes reasoning for the stage "Im aware that your operation and absence was to rectify a knee injury, I also believe that your absence is genuine however your inability to attend your work has breached the standards" did he expect me to work on crutches!!! What a complete trumpet

Standards do the same " standards" apply to them or do they have Standards?

Should your absences from work trigger a consideration of dismissal prompt incorporating this stage 1 formal notification for your 4 month absence for corrective surgery to your knee then obviously you would take this to appeal stage.
If appeals manager does not show some common sense and upholds the dismissal and very much doubt an ET will take a similar view as your case would have more than a reasonable chance of success.
