overtime not day in lieu

Hi 2 people in our office wanted to be paid for their days off (xmas day and boxing day) but have been told by manager they cant and that they have to have the holidays? i thought id heard on here that you could have ot as an alternative to a day off in lieu?? thanks in advance

3.4 Rest days will apply in line with normal year round arrangements. Attendances may be varied by local agreement to take account of workload forecasts and service requirements. Where workload requires people can volunteer to work their normal rest day in return for a day in lieu or scheduled attendance

Where a rest day falls on a Bank Holiday (i.e. 25, 26 December or 1 January, plus 2 January in Scotland) and it is not operationally sensible to transfer the rest day to another day in the same week people will receive an additional day holiday (including those working ‘a week off in six’ or other variations on this theme) in the form of a day in lieu or alternatively the excess hours can be taken as normal overtime.

It is in black and white in the xmas arrangements 2013/2014.
It isn't down to anyone's discretion.

Again and I know people disagree but it doesn't state who the choice is up to, it doesn't say the postie or dom decides

pretty much plain english to me no day given in the same week you basically have a choice paid or or day in lieu.

i've got 10 outstanding days in the bank, asked gaffer today for some time off and he said "we cannot authorise any more leave days before the end of march so you'll have to carry them over!
"Just take it out and see how you go......."

yes i know but it then goes on to say:

Discussions with local CWU representatives should ensure Christmas arrangements are concluded in line with national agreements. Details will be negotiated locally to secure reliable staffing, ensuring everyone has a fair and manageable workload, and will consider the following options

so not just as simple as saying i want OT

But you don't need to secure reliable staffing on a Bank Holiday.
That bit refers to the possibility of shifting the day off or not.
Then all that needs to be done is ask if the OPG requires a day in lieu or to be paid the hours as overtime.
Apparently HR can give you the PSP code to allocate the bank holiday hours as o/t.

no but by allocating someone the bank holiday as the day off it may mean more resources when needed later in the week, thus securing reliable staffing.

From the doms point of view it costs more to pay OT for the bank holiday when he may be able to cover that day off later in the year for free with lapsing, and my point is yet again its another national agreement that doesnt explicitly spell out its the posties choice, there conflicting bits of information in it

The way i would rea that is that it's up to a manger to give you another day off in the same week, if they can't then is up to you to take holiday or the pay. The argument is you can't work your day off this week like others can so you should be allowed to book it. I have booked it on a few occasions when I showed them this .
