I have a query that i hope someone on here can help me with.
I have a 24 hour part time contract working 10-3.
In the past couple of weeks i have had 2 managers. The first one told me if i work over 4.5 hours a day then i am entitled to overtime due to breaks.
However this week there is another manager in our office who said i get paid till 3pm so i work till 3pm, but over the week that is 25 hours not 24.
I do not have a break due to starting at 10am and then going straight out with my partner and it is not practical to have a break out on the walk so i work from 10am onwards.
So i am wondering which manager is correct and what are my actual hours/breaks, none of this is in my contract and if the managers don't know how am i supposed to know?

You ARE entitled to a break

So looking at that, as i don't have a break at 10am or on my walk then if i take my break at the end then my hours actually on the ground are 1000-1430?
Anything over 1430 should be paid, if i haven't had a break?
I am not sure what i am expected to do with regards a break. I can't take it at 1000 as i have just started and 9 times out of 10 my partner is waiting for me to go out and then as we are working together i can't take it on the walk. (he has his between 9am-10am when he's waiting for me)
One other thing, if my shifts are 10-3 over 5 days then that is 25 hours. My contract is 24 hours so where does the other hour go? Are my mondays or tuesdays earlier finishes?

What you need to do is get an agreement with the manager and your colleague as to when to take your break or whether you can claim it as overtime - either way you need your managers permission toeither finish early to take account of the break or to claim it as overtime. As you work less than 6 hours then the working time regulations do not apply and in theory you can take your break when you want, but as mentioned before its best to get an agreement with your colleague and with management.kingeric wrote:I am not sure what i am expected to do with regards a break. Remind the manager and get them to make a decision - more likely he'll either ask you to come in late on Mon/Tue - however, with his permission you could claim it as overtime.kingeric wrote:One other thing, if my shifts are 10-3 over 5 days then that is 25 hours.
