Phoned in sick Wed night,manager phoned Thurs and was told i wouldnt be back Fri,just crawled downstairs to answer the phone to the manager again to be told she had just got back from knocking on my door to no answer and she wanted me to attend an interview in the morning,told her no chance.

Yes they are entitled to come round to your house. They would say its their "duty of care".

As we all know it is just them checking up on you to see if you're swinging the lead.

She cannot compel you back to work. It is up to you in the 1st 7 days to decide whether or not you're fit for work. After that you must get a doctors note for any longer.

Don't worry about not answering the door either, sick people still need to shop and often have to go to the chemist. It could be that you were feeling too unwell to get up or were asleep as a result of your illness.

The 'duty of care' reason given is normally an excuse to check up on people and deter others to go sick .... a manager should have better things to do with his/her time.

The only thing I would say as it happened to me is
Last year I was off with work related anxiety caused by my dom, I took advice from Area Legal and medical rep to say that if they rang meaning Dom that by answering the phone it would make my anxiety levels go up, I was issued with a doctors certificate for the two weeks off .

The dom rang a few times but i let the phone go to answer machine and ignored it

Then in the last week I got a letter from the dom stating if I did not make contact even though they had the medical cerificate that i had abandoned my service which then was 22yrs service as if i would do that this all stemed from a dog bite issue, so for RM to say they have a duty of care they don't give a flying FxxCK

SO make sure you have back up

A DOM once docked me a days pay because when he knocked at my door and spoke to me for a couple of minutes I wasnt being physically sick.

Needless to say he got bollocked off the Union rep and I got my cash back.

The (National Agreement) Attendance Procedure clearly states, "Absences due to sickness are assumed to be genuine".
