Actually getting paid for overtime
the latest wrinkle to hit our area - you have to inform your DOM if you think you will be late - fair enough i can live with that
BUT he now comes out with -i have checked the figures for our mail and its down 10% for today (on figures he calculated ) - so i am not accepting that you will be late -so if your late its your fault and im not paying for it - no appeal or anything his word is law etc etc...
we argued about this so they started counting the empty slots on our frames and worked out the percentage - this quickly stopped when the figures didnt tally there way
now they have just carried on with same argument - your problem not mine and we are not paying
is this legal ?

I believe that been given more work than is reasonably possible to complete is in breach of employment law no matter what job it is. If you are consistently given more than is reasonable to complete, i.e. impossible to do within your hours, it becomes a grievance matter. Hopefully someone will comment whether this is the case and obviously there's the term 'reasonable' which needs to be worked out.

just invite him to go out with you. take it all, don't cut any corners, jump over any fences or owt like that, he will then see how long it takes!

To open up that discussion you perhaps have to go into a procedure. Maybe RM and the union have set ways of going about resolving this kind of thing, a rep might mediate perhaps or something. Someone else can inform you there. Basic employment law as far as I get it is as I stated before. In answer to your question yes it is illegal to be given more work than you can complete. It's a form of bullying. Bullying needs tackling by each employee in all instances.

Slavery is alive and prospering at RM in 2011. Non payment of OT is nothing new. How can it be stopped? I've been down this road. This may sound over simplified but as a new starter, one of the first people you will meet is a union rep, probably on your induction. Then probably the first person that will talk to you at your office will be a local rep making sure you have joined the union. Why the hell do these people not imform you of what is obviously going to happen to you and the consequences of going over your time and/or the options open to you. Every local rep should make (should have made) it their duty to chase up any under payment for a new starter. It is in the interest of the full timer to look after some poor postie on a 3 month contract because if they are not looked after the erosion of rights spreads and has consequences for full timers.
I wish I knew then what I know now when I was on a one hour contract but I had never visited this site until I'd left RM and was going through an E.T. Having said that a full time employee in his first 3 months has as many rights as an employee on a temp contract.
Reps, look after and nurture your new starters, chase up the manager if a new starter is having problems with completing or underpayment. Surely this cant be too difficult? Don't leave the poor person feeling isolated.
Or Reps, are you having a quiet life and couldn't give a flying one?

If you don't have enough time to complete your round, and they can't be trusted to pay you for your overtime, then cut off. I know you'll get a lot of hassle (and probably harrassment) from your DOM for doing so, but why work for free?

These type of behaviours seem widespread in RM . What works for one manager is adopted by others and then spreads.I must have heard most of these coercive tactics used at one time or another.They need to be understood and stock responses provided for our staff to deal with these tactics.

My Office did that, it is an attempt to intimidate you, frighten you into working more for less, that just makes me mad and I get stubborn when these things happen to me, I have called their bluff and challenged them to come out with me , count my letters, put it in writing, they haven't pursued it, they occasionally try it on now and again, I just slap them down, some in my offices are now cutting off and the Linos taking out the excess. you reap what you sow

Don't be intimidated. Work to your time and cut off. If they continue to say it can be done in the time allocated, point out to them it clearly cannot. They can walk test your duty or speed test you but they cannot make you work over your allocated hours!

Do you know that you can file a case to an employment tribunal while you are still employed for unlawful deduction of wages, which is not paying for hours that you have worked. I don't even think that you have to have been employed a year.
It will take a brave person to do this while still in RM employment.

Yes it is illegal to make you do unpaid overtime.
You have 2 choices here - do the work and ask the guy for your money OR work to your hours.
1) If you do the work and don't get paid you can put in a grievance form AND launch an employmnet tribunal case for unpaid wages and/or enforced unpaid OT.
2) If you cut off, you ask your LM what he want's you to do with the mail you don't have time to deliver and he should say either leave it in the frame, put it in a bag for someone else to do or take it out and bring back what you don't have time for.
Either way get a diary TODAY and start wrting down EXACTLY what happens, what you are told by who etc. You will need detailed daily notes for the grievance proceedure and a tribunal and with these your case will be ROCK SOLID. They haven't got a leg to stand on!!
Don't sweat fella they try this on up and down the land. It's a scam, don't fall for it!
