Sick Procedure

Hi Guys, Can you help my mate out please? Young Girl at my office (Full timer) has been on the sick for the last two weeks, she got a special delivery from her DOM this morning to arrange a meeting on Friday next week to see if she can go back to work but her doctor has signed the fit note as she is not fit for work? Can her manager force her back to work and over rule her GP?
Also she thinks she will be able to go back to her duty on the Thursday when she signs off in two weeks from the sick but that would be her day off, will she still be entitled her day off because she was on the sick?

Only from my past experience in another trade - Nobody can overule the GP and if her REGULAR day off is her return day then she should return on the Friday......As I say, from another industry , not RM

This is just me thinking here.....

I would go back to my doc and tell him about the pressure the manager is putting her under wanting to over rule his sick note, hopefully he will get onto the manager....
If she is on a regular duty then I would say yes she would be entitled to her day off but as they count Sunday against you for the purpose of discipline I guess they would add that onto the days she has been off.
However contact the union would be my concrete advice....

The DOM's don't take any notice of what ATOS recommends either, DOM does'nt stand for Delivery Office Manager it stands for Doctor Of Medicine apparently :nervous

Been off last 5 weeks with at least 2 more off, managers tried to get me in on light duties but I told them no, I had a sick note saying not fit for work so no work for me. Nobody can force you to work if your genuinely ill.

The meeting will be or should be just to see how's she's getting on, nothing more nothing less. It's common practice. She has a sick note so the manager of Atos CAN'T say she's fit for work. Only her GP can decide that. The manager may try to pressurise her into coming back early depending on what kind of person they are, but he can't force her. Also she is still ENTITLED to her day off on the Thursday also.

4. If management have any authority to any time disregard medical opinion of employee's GP or occupational health adviser.

In response to point four of your request, the line manager is responsible for the workplace, his team and their health and safety. Advice from GP’s and Occupational Health is highly important when making decisions regarding sick absence cases. Their advice always informs the final decisions which are made by our management team.

it would be a brave manager to over rule a GP. ask the manager to sign a paper to say he is now more clued up then the GP AND Will take full responsibility if anything happened to her. i would quote DUTY OF CARE. good luck .

In my experience, the Manager WILL try to overrule the GP. However, as several people have already said: If you ask them to put it in writing, they back down. Although, they do tend to get quite nasty with you, when you go down that route. The fact is: No Manager can overrule a GP. Although apparently ATOS can, so tell her to watch her back.

Does this not leave the final decision with the Managers? Talk about passing the buck!
