Late??? SD

Had an SD for the end part of my walk this morning. No way I was going to get to it before 1pm so cut off and went to the place to deliver it at about 10.30. Got there and it was controlled entry no answer etc. Couldn't issue a 739 as I couldn't get in. Went back and carried on with my walk and got back to the address at about 1.45. Flat resident was in and signed for the SD with the time on the card saying 10.30... no problem he said as long as I've got it.

NOW if the resident had kicked up a fuss and the sender complained that the delivery wasn't before 1pm whats my position with the DOM?

Strictly speaking when you first arrived at the flat at 10.30 and couldn't gain access you should have contacted your office and let them know the address was inaccessible.
Of course then we get into the whole "cost of the phone call issue".
If you had a PDA there is a system for recording inaccessible signed fors.

Exactly..... a while back I was handed by a member of the public an opened SD that a postie had unwittingly dropped in the street earlier that morning. Not wanting to have an open SD for another posties walk in my bag I called the office. All in I spent about 5 minutes on my PAYG phone dealing with it costing about £1.50. Would the DOM reimburse me? like bugger would he. Hence I don't use my phone on RM business. Sad init!

Simple answer is to endorse the 10.30 time as 'no access'. Write the number from the SD in the last box of your delivery card with the correct time and get a signature there. Then run your pen through the 10.30 box and write "delivery re-attempted, see below" that's what I always did and never had any problems with either complaints or DOM as delivery was attempted before 1.00.
