Expected to work indoors after accident on duty.

Hi guys, been a while since I've been on here, but I thought what better place to ask.....well, a friend who works at a different office to myself, slipped on ice last week whilst on duty, resulting in a fractured (right) wrist. She as been signed off work for at least 2 weeks, but the very same day as the accident, her manager got in touch saying they they have found indoor work for her to do and they will send someone to collect her from her home on Monday!

She asked me if they can force her to work, but in my opinion this is surely illegal, at the very least it's arrassment, what do you guys think?

If she has been signed off as "Unfit for any kind of work" by a doctor ( or ATOS ) then she is unfit for ANY work....the fit notes that Drs issue now give an indication of how much work any patient can do, if they can't work for 2 weeks ( in Dr's opinion ), they can't work...and if Dr then updates it by more time off, then that's how long they stay off work. When he says they can do sitting down work ( say indoor letter sorting ), that's when they can do that, if he says light duties that don't involve sitting down ( say caller's ), that's when they can do that, when he says anything, that is as far as you need to go....and unless your mate's DOM is a consultant orthapedic surgeon in disguise, I'd tell him to get rooted!

If the Doctor has signed her off as unfit to work, then she's unfit to work. Admittedly, there's nothing wrong with her legs so no reason why she can't but that's not the point.

I'd tell her to tell her manager that she's going back to the Dr's for advice on Monday and that she does just that. If her Dr says OK then they must give her a note telling the DOM exactly what she can/can't do. They are liable to getting sued if they make her do something she's not meant to be doing, i.e. against medical advice, so if she gets it in writing, she's got more rights.

P.S. Personally, I'd take the time off... they can't sick absence you for an AOD so it doesn't count towards stages. It might trigger them, but they can't be counted. Plus, she won't be losing out on overtime by staying off as she won't be allowed to get any anyway with her being on "amended duties". Also, if she does go back, make sure she gets a decent rehab plan that her Dr agrees with, in WRITING!!

Aod can and have been counted if the accident was the persons own fault. Do not agrea with it but it happens.

But she slipped on ice so I doubt that can be counted. I contest it very strongly if it was.

It's not as though she crossed the road without looking and got knocked over.

In my last job the manager (who had recently attended a 'managing sick leave' course) had to send someone home who came in while signed on the sick. Apparently he was he was not covered by the companies insurance while having an unfit to work Doctor's note. Not sure if this would apply to RM???

any accident at work which results in the injured person being absent for more than three days has to be reported to the health and safety executive who then have to investigate the accident.management in any industry not just RM are reluctant to do this as sometimes H&S see more than thet should and this could lead to unwanted costs to rectify problems
