Pro-rata D2D in breach of Equal Pay Act 1970?
Postie here from the North East. 10 years service. Own duty with 727 Drops. 27 hour contract.
After reading the agreement the one thing I can't grasp is the Pro-rata D2D payments. There are rumours in this forum that the reason it's going to be Pro-rata is because FT staff will be prepping them for PT staff. When I go in I'm supposed to be fully prepped. There's been 1 tray of mail (if I'm lucky) boxed in. I still have another tray to do and a full bench from the Primary. Even with better automation there is no way a Full Timer is going to be able to do IPS, box themselves in, box a Part Timer in and prep D2D's for both duties.
I can't see that working as there just won't be the time so that means I'll be prepping and delivering the same if not more D2D's than FT staff yet receiving less money. After doing a little research this is very shaky ground and may very well be in breach of the Equal Pay Act. Without complicating things... If I have to prep and deliver D2D's and get less money than FT staff who do exactly the same then this is in breach of the Act. I know FT staff do more hours, that is a separate issue. But whether your FT or PT you will have to do D2D's. We all prep and deliver them so the same payment to each member of staff regardless of contract. If all my D2D's are fully prepped for me every day then the pro-rata payment makes perfect sense, but nowhere in the agreement does it say that.
One final point... does this mean Lapsing is now scrapped? Coz I'm sure as hell I won't have time to do that on top of prepping 6 D2D's Oh and that means every door every day.
I don't know about other Posties but when I have every door it ads at least 30 minutes to my round. How long will Royal Mail allow each Postie to book 30mins to an hour every single day? Hmmmm. I think the Pressure sheet might suddenly dissapear

while i think its disgraceful what they are doing,i think they will get round because d2d is now/could be part of your work load and the payment you get is a delivery payment/supplement . so they will argue your contracted to deliver them as its now part of your work load not separate with separate payment. if that makes sense.

daveyctvr: According to the agreement, your duty will be adjusted to allow you time to do whatever work you are given. Your duty might be changed beyond recognition. Your 700 drops might become 1500 drops, there'll be two of you, in a van, doing all packets, specials, everything.

No it will not breach.
The supplement is basic pay supplement so is based on hours worked. DTD and shift money is funding the supplement. It is not a DTD supplement.

Even if your D2D are fully prepped, you are still carrying the weight, that is, doing the same work for less money. You might be right: it might be illegal. If anyone finds out, let me know.

So in Laymans terms..
In my office I work beside a Full Timer. We both have just over 700 doors. We both get 6 D2D's one week, he collects his £20 at the end of the week and I collect my £10 yet we've both prepped and delivered 4200 items. We both have 3.5 hour walks at the moment I'm taking home £200 after tax he's taking home £300 after tax. Yes he does more hours IPS before I start but the D2D payment should not simply be a 'delivery supplement' or whatever they want to gloss the sh*t up with. It should be separate from all that.
I can understand when I'm still in bed I'm getting boxed in by a Full Timer (that's why he gets an extra £100 a week more than me) but once I arrive that's it. Unless they're all prepped up for me then we should get the same and it shouldn't be tied in with how many hours you work. If you prep and deliver 700 D2D's and a full timer preps and delivers 700 D2D's we should get the same period!
Another point that just hit me...I thought we wern't allowed to bundle D2D's up inside each other as it causes certain items to dominate others etc. So what exactly does prepping D2D's mean then?
I read somewhere on here that if it was a standard payment for everyone regardless of contract it would be £18. That's only £2.60 less than the full time payment, not much of a loss for FT staff and a fair deal for PT staff

What is happening is we are moving to a system where by all delivery office workers get the same hourly money which is why supplement is pro rata. This means those who dont DTD will see a nice rise . All well and good so far, but the way its hapening (3 year pay deal) and the supplement being funded with mainly current money and and not a lot of new money compared to the current money figure. Untill all three pay rises kick in some delivery workers may see a drop. 6.9% now then nothing for three years would counteract it.

Some interesting points I've pasted....
3. Comparable full-time workers
• Part-time workers can compare themselves with full-time workers who work on similar
contracts in the same establishment.
• The comparable full-timer must be engaged in broadly similar work having regard, where
relevant, to whether he or she has a similar level of qualifications, skills and experience.
6. Rate of pay
6.1 Hourly rate
• Part-timers must not normally receive a lower basic hourly rate of pay than comparable
full-timers.
• An employer may pay part-timers a lower hourly rate only where this is justified on
objective grounds, for example where a performance related pay scheme is in place and
the full-time worker and the part-timer worker are shown to have different levels of
performance (as measured by a fair appraisal system).
7. Enhanced pay (bonus pay; shift allowances; unsocial hours payments)
• The principles detailed in paragraph 6.1 above apply to enhanced rates of pay.
• Where special rates of pay apply (which may include bonus pay, shift allowances,
unsocial hours payments or weekends payments), part-timers are entitled to the same
hourly rate as a comparable full-time worker.
This may sound naive but the 'delivery supplement' which the D2D payment will be made up of will to some degree discriminate against Part-time staff. If we have to do the same length walks and prep and deliver the same amount of D2D items as Full-time staff yet receive less money. I don't think the supplement of £20.60 would fall into basic pay part of the law but it seriously needs some looking into. There is definitely something fishy... or am I just being optimistic?

There is no d2d payment anymore
I think RM would put it like this: d2d isn't paid for ANYONE anymore, end of, and the new payment is simply a pro-rata bonus.
Now that is one way to look at it which makes it totally legal as it's based on attendance hours. The fact the money is comming direct from d2d revenue and PT are loosing that more than FT are loosing it makes it morally corrupt but probablly not illegal. Vote NO.

part timers will infact get 3 pounds a week more than a full timer as we will lose our early morning allowence but we need to still vote no
