Re: Thousands of Postmen and women to lose their jobs!
reading the past couple of pages is worrying. Can somebody please tell me where i could stand. Currently on 24 hour contract, but dont know if it permanent ect ect(also never had anything confirmed/unconfirmed by DOM). My previous 2 contracts had an end date but my last one, a good 6 months ago didnt have an end date, so does that mean im on a permanent contract? cheers any help would be appreciated

Look on the first page at the top and if it states 'LONG TERM CONTRACT FOR OPERATIONAL POSTAL GRADE', then you have a permanent contractmozsupportsrovers wrote:reading the past couple of pages is worrying. the same law that makes a ftc not legally allowed to exceed 4 years without justification also states
"(5) A collective agreement or a workforce agreement may modify the application ...
a) the maximum total period for which the employee or employees of that description may be continuously employed on a fixed-term contract or on successive fixed-term contracts"
we have a collective agreement of 2 years so the law for us is 2 years. unless they can reasonably justify it
if u have over 2 years service and are being told they aren't renewing your contract they first have to reasonably justify why. if they cant take them to an ET.

It cost a small fortune now to take a case to tribunal thanks to these Tory business loving twerps

You've got to be kidding, there are people in my office with THIRTEEN years service who still haven't got a permanent FT contract. Some of those on temp FT with 10 years service were told last week they're being put back down to their contracted PT hours.chrisj wrote:I think the last example has more than a case. I doubt there will be an office that has not had a full time vacancy in 4 years or have not had a revision... I know there are still a few out there but being a temporary full time for 4 years is almost unheard of and should have been dealt with.
As for being on FTC for 4 years, there is a bit of a loophole in that the employment should be continuous, I think. If we are talking Agency staff then the simply lay them off for a few months here and there so that they do not have to employ them on a on a permanent basis.
Either way, there are some loopholes depending on local conditions and business/operational reasons.
RM might still employ the odd 20+ hours here and there but they are now sharing them between offices - so you now have Reserves that are not just confined to one office and the odd move here and there but continuous movement from office to office.
2 years and you get a permanent contract in my office, but permanent FT is another story altogether,

yes take them to a tribunal, if you have a case the union will support you. giving up just because something is hard will let RM win every time. join the union ,use the union and fight for your rights! soon as people stand up to this and win an ET then the precedent will be set for all the rest.Take them to a tribunal?
