I agree - El Cartero is a shotgun poster - he starts threads randomly and without thought. He changes his mind on subjects sometimes from one post to the next. He complains about stuff in his job and does nothing to resolve them despite getting advice and encouragement on here.

My main reason for posting my comment was not to back up El Cartero but to point out that everyone is allowed an opinion but only those that can actually vote on the deal/issues in question, have an relevancy.

I'm sure joining a union with no recognition agreement would really strengthen your hand in the workplace :confused
oh dear employment law isnt your bag baby, is it.can anyone tell lovejoy what percentage of membership of a work force to any union makes recogintion mandatory

Actually perhaps you don't fully understand it as in this case with a Union currently recognised and with the law favouring single table bargaining and with the fact that for two Unions to be admissible, the unions must show that they will co-operate with each other to "secure and maintain stable effective collective bargaining arrangements". Unions who make a joint application must be willing to bargain together on behalf of workers in the bargaining unit. http://www.unison.org.uk/bargaining/doc ... 82&pid=205" onclick="window.open(this.href);return false; make recognising a 2nd Union for CWU grades difficult to say the least.

Of course you could de-recognise the Union first but there are hurdles there as well and 40% of the membership wanting to leave might be good enough for a ballot on derecognition but not enough to carry it, but even that's questionable according to the following page.

A worker's application to the CAC
Where a worker believes that their union no longer has the support of the bargaining unit, they can apply to the CAC to hold a secret ballot to determine whether or not collective bargaining arrangements should end.

A worker can only make such an application after three years of statutory recognition. However, unlike employers, they do not need to first make a request of the union (or even the employer) to end bargaining arrangements.

The CAC will only accept the worker's ballot application if:

it is made in the proper form
they have copied the application and any supporting documents to both you and the union
at least 10 per cent of the workers in the bargaining unit favour derecognition
a majority of the workers in the bargaining unit are likely to favour derecognition
there hasn't been a previous application for an end to the bargaining arrangements in the last three years
I think your error was in thinking that minimum numbers joining a Union and it being recognised applies when there is no recognised Union already representing the workforce. Its an easy one to make TBH.

Reminds me of the time when Viagra first came out and I had called at the pie shop on my way home from delivery, these two old biddies were talking about viagara and one said to the other "has your husband tried it", "No she replied" - they both then turned to me and stared, made me feel a little uncomfortable TBH, then one of them said "can you get it over the counter" - and I said "I might be able to if I took two" :d'oh! :chuckle :chuckle :chuckle
