Use RM's stalling tactic against them now, save your money for more hard hitting strike action.

How can they possibly believe that this is going to help matters? They could have started with meaningful negotiations straight after the ballot and if progress was made, the union would have suspended the strike action.
This way will only produce more bitterness and resentment, it is baffling.

Someone tell me that I'm wrong (and why) if I now think any deal put forward by RM will have to be justified by CWU as being unreasonable to ACAS rather than just waiving it away..?

Lets all stay Positive, it's a disappointing outcome but it was always a possibility. Unfortunately we've just got to play by the rules. It's not the end of this, not by a long chalk.

But to answer. ACAS will be a go-between and a facilitator they will make no judgement on whether the deal is a good one or not.

Or as they put it:

Acas is an independent and impartial third party, whose role is not to direct either party on what to do; but to help them develop options and solutions to resolve the dispute.

I'm surprised that no-body has stated a very obvious fact about the mediation process. If RM believed in the mediation process as a method to resolve this dispute why did RM not instigate a request for this mediation process to occur say 2+ months ago or so when the CWU laid out their timetable for action? Seems to me that they were oblivious to all the warning signs of a massive % vote for IA. RM have been disingenuous at best and downright devious at worst for only using this injunction as a potential way of stopping any IA and not requesting mediation before now. They will need to make more concessions to ward off potentially damaging IA in the weeks before Christmas. And please if anyone from RM reads these posts NO MORE PDA messages until this dispute is resolved.

The External Mediator will be appointed from a jointly agreed panel managed by ACAS and will have no other connection with Royal Mail or the CWU.

If I am quoting the relevant bit of the agreement it isn't as simple as "going to ACAS"
First they will have to appoint a jointly agreed panel.

It concerns me as to why the condition of "5 weeks external mediation before any strike action" was put into the Agenda for Growth agreement? I always thought that we had an IR Framework Agreement that was there to cover industrial disputes?

A more cynical person would suspect that this is Royal Mails way of attempting to undermine and make changes, by stealth, to the IR Framework agreement....?

High Court confirms contractual dispute resolution procedures must be followed before industrial action

Royal Mail (RMG.L) confirms that the High Court has today ruled that the contractual dispute resolution procedures under the Agenda for Growth must be followed before industrial action can take place. The court's final injunction means that any strike action before the dispute resolution procedures have been followed would be unlawful.

We will now make contact with the CWU as a matter of urgency to begin the process of external mediation. The mediation process will take close to Christmas to be completed, and may be longer. The first step is selecting a mediator acceptable to Royal Mail and the CWU from a panel that was agreed by both parties under the Agenda for Growth.

The Agenda for Growth is a balanced agreement which gives significant protections to Royal Mail employees. In return, the CWU committed to an industrial stability framework with defined processes and strict timescales to resolve disputes. We want to use them to do just that.

We are very committed to working closely with the CWU in order to reach agreement as a matter of priority.

It wasn't even by stealth though, it was there plain to see for all, practically in 30 foot high neon writing. Bit annoyed that the CWU was naive enough to let it slip through to be honest.
