OH Calling me when on annual leave .

My main complaint is how can ATOS sign off my report on Friday and then I'm getting told today I have to go back ? Before I spoke to ATOS my boss told me they will defo tell you to go back to work what ever they tell you goes I said ok that's fine . Turns out that's only the case if it works in royal mails favour !! Hence the reason they have put through another report on me !!! What I really want to know can they do this ? Also if I do go back next week them off for my op and up to 8 weeks recovery will this go down as another sick ?

On the initial OH Assist report they stated that there would be no further communication with them for 3 weeks taking you up to the date of your surgery. You are entitled to be copied in on tis report and hope you have this in your possession.
When you have been referred to OH Assist for recommendations as how best to handle your medical condition you are in theory come under their control but as you have opted to take annual leave within your absence dates then as far as they are concerned they have closed your case file for it to be re-opened again on return to sick absence and a further referral to be issued. That was why I wanted you to contact OH Assist on your holiday break and have this as part of your recuperation prior to your surgery without an interval in the GP fit note and get your leave entitlement credited to you.
Your boss is threatening you on stating that you have to return to work as your original sick note is still valid unless you have had it amended and therefore you are sick and it is up to your boss if he wishes a further referral to OH Assist to be made.
In relation to determining the absences you are currently unfit for work and it is known to management that you have to enter hospital at some stage for CORRECTIVE SURGERY for this medical condition and therefore should be classed as 1 absence including the post op recovery time. Furthermore due to the nature of your work this surgery is required to enable you to full fitness for completing your duty and with the assistance of a screwed on union rep the time absence should be discounted from stage procedures in the attendance procedure.

We don't have a union rep and the area rep in with the boss lol

If your on the sick your holiday week gets cancelled, it happened to me last year, had an injury 2 days before my hols and I was going away for the week, told the dom and rep about it and got the week back later in the year.
