Can they get you for wilful delay, if you cut off? Do you have to let them know your intentions beforehand?

The way I read this. The 94% will be made up of recipients who are not in, wanting their parcel left with a neighbour and not the neighbour you knock on wanting to take it.

What sort of % approx have the sizes of the cut-offs increased by from having to try 3 neighbours each time (wouldn't surprise me if it ends up with you returning just as many packets in the end)?

Deliver to neighbour is for TRACKED ITEMS only, as they are easily monitored for quality.
All other items such as recordeds & parcels are to be P739 if they haven't requested in writing to DOM & added into A plus (walklog) a suitable neighbour. Or a safeplace which has been risk assessed for security.

It is only tracked that i try neighbors for,i do not have any problem with that.

That isn't true, all items have to be treated the same except specials and international items which cannot be left with a neighbour.

If they really want their Trackers delivered to neighbours why haven't they left those instructions on the packet?

I don't think that is the policy, your personal approach?

One thing that doesn't help DTN operation is the increasing lack of knowledge of each round due to constant changes in staff on them. In the desperate effort to become more lean under privatisation many rounds in our office have no real duty holder and increasing numbers of rotating 'short hours' contract personnel are covering them in either full or lapsed form. If you have good knowledge of a round you know where you can deliver parcels of all types with no hassle (and speedily), but if you are on a round that you only cover occasionally you just don't have the knowledge to do that as the company are requesting. This is where the fears of a late finish come in and the P739's get banged through the letter box.

I couldn't get rid of a tracked yesterday. I looked to the left of the house was a field. Looked to the right was a field(you know where I'm going now) and opposite was a field. I gave in and 739'd it. :Very Happy

A: Whether you have any legal rights will depend on the delivery instructions you did or didn't give at the time of purchase.


Specific delivery instructions
If you give instructions for your parcel to be left with a specific neighbour and the parcel is delivered to them, the seller is not responsible if something goes wrong.
In this instance we would recommend contacting our Consumer Rights Advice Line to speak to an adviser for tailored advice on what action you should take.
If you agree more generally that your parcel can be left with a neighbour without specifying which one, then in practice you’ve said you are happy for anyone in close proximity to your home to accept delivery on your behalf.

Who is considered a neighbour?
There’s no legal definition of a 'neighbour' but dictionary definitions suggest it is someone that lives very close to you (Cambridge dictionary) or someone that lives next door or very close to you (Oxford dictionary).
So if your parcel is left with someone 10 doors away, you could argue that by definition, a neighbour is not someone that lives this far away.
In this instance you could argue that delivery has not taken place and that the seller is in breach of contract.

You could also argue this if, for example, you live at 5 Friendly Street and agreed that your parcel could be left with 7 Friendly Street, but it was left with a different neighbour.

Parcel left with neighbour
If you're parcel is left with a neighbour without giving instructions to do so, you can argue that the contract said the goods were to be delivered to the address specified, and that by leaving them at a different address the company is in breach of contract.
The Royal Mail recently announced that 'subject to regulatory approval' it intends to offer a Delivery to Neighbour service enabling packages to be left with a neighbour rather than putting a card through the door.
Anyone that doesn’t wish to participate in the scheme will be able to put a sticker on their letterbox which will make this clear.
