Maybe I didn't make my posting clear enough. You stated that at your meeting with DOM he brought up further complaints from as long ago as 12months. If he is now bringing these past complaints to the forefront in order to build a case against you to warrant disciplinary action then he should have at the time written to you advising you that any further complaints may lead to you being taken down the conduct code. As he obviously has not written to you on complaints from 12 months back then he cannot take this into consideration when attempting to build a case against you.

Unfortunately Clash is right and it doesn't matter if you, me or clash refuse to accept it, the current level of proof in an Employment Tribunal is "Reasonable Belief" and that the actions taken because of that reasonable belief is itself within a Reasonable range.

Ok the sticking point here is with the tracked item failing. Doms have been instructed to take the 3 C's action to try to improve the quality. We have had one caution and another conduct warning in the past 3 weeks.
The other cases are very weak and is something that every postie is guilty of. Not sure why his bothering with those tbh. I would suggest you take in your rep and take the tracked fail on the chin. Let the rep argue the other minor complaints.

well thanks for all your advice.... I suppose il have to wait and see what tomorrow brings...sadly for my own personal reasons I come out of the union some years ago,although just recently had decided I was going to renew membership-nothing to do with the recent run in with management....does anybody know how soon you are covered by the CWU from emailing/posting your application off?krussel wrote:Ok the sticking point here is with the tracked item failing. Here is one case where 'reasonable belief' turned out to be wrong, but too much time passed for the wrongfully-dismissed employees to go to a Tribunal.

Service and goodwill to all men have now disappeared in this company, it's all f*** the paying customer , just do your job properly or p*** off!
Used to "buy" surcharged letters , especially just before mothers day and christmas cards etc and get the money off the customer but you can't help anyone out now, they must come to the office and pay for it or try and find a friendly post office (HA HA ) P.S. is this surcharge cash properly regulated and counted - I think not- I know not
Also dom says any cards with vague or incomplete addresses must be killed off same day and not kept on your frame until you remember where it should go etc. - even when most have no return address - maybe the cash inside them is held at Belfast ??
