AFAIK they were forwarded the 'details of injuries suffered' from the ERICA in order to get background information for the initial phone interview regarding my ability to carry out duties. Common sense really.

It is compulsory for the employee to complete an Informed Consent form.
Ideally this should be done via a face to face discussion so you can give as much detail around this process as possible

The ERICA should not be passed on for this purpose!

The Manager only needs to provide contact information and an overview of the injury in order that an appropriate OH operative can initiate the first contact. The details of an accident have no bearing on the type or level of care you receive from an Occupational Health Professional.

A broken finger is a broken finger as far as capability is concerned, it matters not if it was caught in a closing gate or whether an incident with a damp sheet of toilet tissue meant that you took yourself bowling in trap 4.

I personally have no idea if it should or shouldn't but I would be surprised if its as stark as that. A lot of injuries are similar but the way the injury occurred can have an effect on treatment, as a First Aider it was described to us as "the mechanics of an injury".

Not saying your wrong, or even that you are correct, but even in the case you gave above a trapped finger in a gate and falling over in a toilet cubicle will have different mechanics and may cause different injuries which may impact on the recovery of the person concerned, and also may affect their capabilities at work.

In a similar case I would prefer that the ERICA report to be passed on to ATOS as the more information they have, the more informed a decision they SHOULD come to. Just an opinion though.

Agreed, which is why I consented to it - it's common sense and removes any ambiguity.

The problem with all of this, is the way RM use your consent after it has been given, Unless you stipulate what you will allow to be seen and by whom. ( Even then they may breach the act by passing your information to other people )
In an ideal world you would be able to trust your manager to act in a resposible way but this is not the case within RM.
They will pass on your reports ect to DSM's and others who may try and use your Heath/Disibility issues against you.
The date protection act is there for a reason, to keep you personal details private,So why would anyone allow RM to abuse it.

TBT I hear what your saying, but ATOS have no need to see ERICA, when you have your meeting with them you can inform them and show them any medical records/evidence you want then.

Looking at this from outside the Royal Mail Bubble.

Royal Mail will have to ask their employee under the Data Protection Act to be referred to the Occupational health Provider. As far as i am aware ATOS is a private outside commercial organisation for which your individual contract of employment is not party to.

The contract is between Royal Mail Group and ATOS, not a Tripartite agreement with the employee

Except ATOS is a part of RM's "ill-health" process and accepted by HR, CWU, CMA etc. Even if an employee didn't pass on any contact phone numbers ATOS would still contact you in person or by post, and that would be more inconvenient than a quick 5 minute phone call.
Why make life harder than it needs to be? ATOS aren't going to give up just because they can't ring you.

Royal Mail like any Data Processor cannot pass out details as to any employee to an outside organisation that is not within its own group of companies. Royal Mail will need the express permission of the Data Subject. It is contained within schedule 3 DPA 1998
