That's the problem April..if your doctor puts "gentle exercise is advised" on your "Fit Note" then your in trouble because your DOM will assume this means throw a bag over your shoulder and cover a 4hr delivery. :roll:

Under the new scheme of things 'only 4 hours' will be gentle, FT.
We'll soon be pounding the pavements for 6 or 7 hours at a time. I can hardly wait.

Precisely why she should stay off as per the fit note which must've just said not fit for work. Gentle exercise means a bit of walking/pottering about, a little bending etc, just so the muscles get some work out. Otherwise it'll take longer to get better. The DOM might try to use that as an excuse to come back to work but at work, you can't take a rest/lie down if you feel you need to. Plus, as I said, you feel pressurised into getting more done than you can as both the manager and colleagues feel you're taking the piss.

I had colleagues saying to me "Oh, you're not limping today then?". Well, no, I'm not going to fake a limp if it isn't actually hurting me am I?! I limped unintentionally when my hip and knee were playing up. Wasn't a conscious effort!
Does this rag smell of chloroform to you?

You can request a home visit, that is where you DOM can see you at home.Dont forget if you have a back problem travelling to work could make it worse!! I was off for 16 weeks and never had a problem. Also Atos Origin never got my medical records and never will.The Government pay sick money Royal Mail only make up your wages, also if they stop your money! which they wont thats discrimination! so unless they stop all sick persons money at present sick........

Make a point of telling your DOM that the whole point of the new Fit Notes, is to get you back to work if at all possible, by providing advice on suitable rehab. So if your Doctor has used it to say that you're NOT fit for work. Then it should be obvious that you aren't capable of doing ANY work. Regardless of whether it's light duties or not. :hmmmm

If your DOM still doesn't back down. Point out that if he/she forces you back to work, and makes your condition worse. Then you'll have an excellent case for compensation. That should make him/her back down, don't you think? :hmmmm

Whatever you do don't go back until the Dr gives you the OK and also make sure your DOM gets an ATOS referral for you. I asked for a referral myself and as of last Tuesday I'm on light duties, half a walk or 1 hour walking max, no pushing Yorks etc. One of the LM's said he does'nt have to abide by what ATOS says........whats the point then? :hmmmm Anyways yesterday they put extra on me and ended up walking for about 2.5 hours. They don't give a stuff about you being injured. My point being is management don't take any notice of any health advice so don't take any notice of what management has got to say on the subject.

This might be stating the bleedin' obvious, but if a manager demands you to return to work before a Dr or Atos ( or anyone simiarly qualified ) says you should return, ALWAYS TELL THEM YOU EXPECT THEIR INSTRUCTION IN WRITING & WAIT FOR THE LETTER BEFORE YOU RETURN EARLY....you'll either be waiting a long time, or be looking for an employment solicitor to make a claim :Very Happy
