im glad you get back so soon ,they(union) seem to think at area level there is nothing they can do for any one whos been there less than a year but i dont think they have actually realised the true state of the law you can only justify sacking someone for gross miss conduct after one year not because there contract ends you are basically the same as permanent employee it is the spirit of the law that is being broken and you can definitly not get rid of people in order to not handing them a perm contract after 4 years this is so grossly in fairPOSTMAN wrote:Has there been any comms from the union?

Royal Mail is trying to hoodwink those of us who are on temporary contracts into signing away our rights.
I was employed on a 3 month contract in 2007 which has never been re-negotiated.
I spoke with a solicitor who told me that the law was very clear on this matter. If your contract has expired and you have not been issued with a new contract you are by default (in the eyes of the law) entitled to the same rights as full time permanent employees e.g. redundancy payments.
Royal mail could have kept me on a temporary contract basis for up to 4 years providing they issued a new contract at the end of each successive three month period.
The same applies to all temporary contracts. A colleague of mine was employed on a 3 month rolling contract for two years. Royal Mail did not cancel or renew his contract at the end of the 2 year period so in the eyes of the law he is entitled to the same rights as full time permanent staff.
If Royal Mail wants to do away with our services now they will have to pay us redundancy or face an industrial tribunal.
If you are on a temporary contract and have received a letter from Royal Mail recently DO NOT sign and return it.

If you or a colleague are on temporary contracts speak to your branch CWU rep before signing anything. If you are not a member of the CWU you should be, through the CWU you have access to professional legal advisers.
PLEASE SPREAD THE WORD TO ANY COLLEAGUES WHO JOINED ROYAL MAIL IN THE LAST 3 YEARS AND TO ANYONE YOU KNOW WHO IS EMPLOYED ON A TEMPORARY CONTRACT.

I fully understand the point you are making and yes that is one way for the company to get around the redundancy legislation. However it could still prove to be a logistical nightmare for Royal Mail as the work still has to be done daily.The timing of any compulsory redundancies would need to be carefully planned and that we all know is not one of Royal Mails strong points!
Also in the eyes of the law some of these fixed term/temporary contracts that have lapsed or exceeded a certain time period, might offer some limited protection against redundancy or may well attract a redundancy pay off. If certain offices are known to be making redundancies and then at the same time or shortly after begin recruiting either internally or externally, its not going to look very good for the company at an Industrial tribunal. Most places I have worked before would look to offer a person another different job within the company and be seen to be doing so, before offering compulsory redundancies.
Royal Mail has mainly gone down the voluntary redundancy route in the past. This might have involved higher payouts but it means no claims against it later, plus it can reposition staff pretty much whenever it chooses. However the fact it has mainly offered VR to the longest servers may well have set a precident and is something else the union solicitors might want to look into.

At my office 3 part timers (30+ hrs) were told today that their contracts are to be terminated.

No mate, he said 2 weeks is what HR wanted but then said he will give them till October, but then he said it might been sooner, so as of yet they still don't know when is their last day, its a disgrace. I can't believe the union didn't pull us all out on strike over this. I am no problem with royal mail rolling fixed term contracts over, but they should at least inform the employee each time they do this, apparently they have been doing that to these full timers at my office for the past 3 years and letting them all believe they were permanent and out of the blue tell them they are not and they are being dismissed in 2 weeks. What a joke.

I heard today that they've told the 3 who's contracts they are terminating that its 'EVR' and they will receive a weeks pay for each year they've been with RM.........so 2 weeks pay, pro rata of course
