Story is took a buy down @ my last office as I was told there were no fulltime posts @ my present office,went from 40 hrs down to 30 hrs took the cash and had a month unpaid leave untill the position @ my present office was available(waiting for a P+L revision).
30 hrs was working ok but was always getting asked to work over, eventually they offered me temp fulltime positon just before Christmas and its still going.HR clock that I am now working fulltime and I get a letter demanding the majority of the money back(which I have spent) and will take 10% of my wages each week untill its repayed now I do not have a problem with paying it back but at a more realistic 5%.But what happens when I go back to 30 hrs as the DOM says there are no permanent fulltime vacancies do i get the money back that I have repayed?
Just thought someone on here would know where I stand

You don't have a full-time permanent contract.
Tell HR the minute they send you one you will open negotiations based on the overpayments recovery procedure.
Until then they can....
The buy down refund policy in MTSF clearly states increasing hours or returning to full-time hours on a permanent basis.

be lucky you got your buy down went from 40hrs to 24hrs about 4 years ago and still not got paid out

Well they have taken 10% of my wages and told me you do not need to be doing "permanent fulltime hours" to have to payback the monies.
Spoke to my DOM and he says that he is unable to offer a fulltime contract even though we have postions available.
Area rep informed do I put a grieviance in against HR recoveries person as nothing has been agreed or against my DOM?

Nothing about claw back,page 5...Any hours Worked in excess of the contracted hours, where the employee is in a grade that attracts overtime rates, will be at the flat hourly rate unless the total number of hours worked exceed what would constitute the normal fuli time hours. Overtime, paid in excess of the fulltime hours, will than be at the appropriate premium rate

I'm going to assume the manager is paying you overtime every week. To make up full-time hours. It really depends on the contract you signed when accepting the reduction in hours. My advice would be stop doing 40 hours.
