A POSTMAN sacked for striking a manager on the face at a long-service awards dinner has won almost £15,000 compensation and his job back.

John McKirdy admitted striking Alex Goldie above his lip but said he had been provoked by his former manager, who was acting aggressively.

A Glasgow employment tribunal heard Mr McKirdy, 50, who had over 20 years' unblemished service as a postman, was at the dinner at Glasgow's Hilton Hotel last year.

He approached a table to tell a colleague a taxi had arrived.

Mr McKirdy saw Mr Goldie standing and claimed he intended to shake his hand. But, he alleged, Mr Goldie pushed him away and his former manager's other hand made contact with his lip.

Mr McKirdy lashed out in response, striking Mr Goldie.He told manager David Donaldson, who dismissed him, that he was defending himself.

Mr Goldie said he had remained seated at the table, and the next thing he knew was a punch hitting his lip.

Mr Donaldson accepted he had not attached any weight to a preliminary investigation's conclusion that there had been possible provocation.

Mr McKirdy was charged by police and fined £100.

The tribunal said reasonable employers would have investigated the issue of provocation. Mr Donaldson disregarded witnesses supporting Mr McKirdy, and failed to test the reliability of a witness whose statements were inconsistent.

A reasonable employer would have adopted a more cautious approach to Mr Goldie's evidence, given his "selective memory".

Mr McKirdy, of Kilmacolm Road, Greenock, was 40% to blame, the tribunal said, but Royal Mail was told to reinstate him and pay compensation.

This will probably be appealed and overturned. Royal Mail appeal nearly everything and win just as many cases on appeal... :sad:

If only they looked after us as well as they do their managers...

A reasonable employer would promote damned liars into management positions.

A sensible employee wouldn't want to spend time in the company of that scum.

Always the same protect the managers at any cost , ignore all the evidence, witnesses, if the manager said it happen nothing else matters absolute disgrace, well done that chairman only time you will get any justice. :Applause :Applause RM internal procedures waste of time.

Yes but if they don't reinstate the comp become's much higher, the chairman will not be happy if RM go against his judgement.

When has RM ever done anything other than follow their own agressive agenda.

Always wondered what these work place Jolly's do = Manager and Employees get togethers literally and the employer always comes behind the manager's i shall not take part in any fraternisation with management!.

The truth regarding RM disciplinary procedures is being show for what it is. Most posties have no chance when it comes to internal appeals, especially when it is against a manager, you have to have your day at an employment tribunal to get justice with this company. This is great news and as made my day :Very Happy :dance
