can anyone advise me i started work with royal mail in may 2009 i came off work for 1 day in july 2010 with a shoulder injury then again on 3 dec 2010 until 3oth april 2011 in which in that time i had an operation to repair a torn tendon in the jan 2011 , i was given a 1st stage warning then i developed family problems with partner walking out on me and not know wheter i had a roof over my head also i was suffering abdominal pain in which i had 1 day off because i had an allergy to tablets in october 2011 then in nov 2011 i tried to take my life through the abdominal pain in which i was not given second stage then in feb 2012 i tried once more and was put on sick for depression through this i returned to work first week in may and i took a union in with me andhave been to a clinical phsycologist and had numerous test and have a atos report saying i may with the pain may need more time off also my depression is under the dda in my atos report but i have been given a stage 2 warning also in my atos report it say 50 percent of my hours more if can tolerate i am preping a walk and taking half a walk out on delivery i am a 25 hours employer where do i stand i have spoken to one union man in my office who is asking the one abouve him as he isup on the dda act

i am sorry you are not getting the support from royal mail but that is not unsual

i am a bit confused so we will take it one step at atime

in your last ATOS report, i take it they recomended a back to work plan, did your manager instigate the ATOS report

when was the stage 2 issued and what reason did the manager give for issuing it

also its not the genuineness of the abscences its the amount apparently

what was the absence or illness (sick leave) that caused the stage 2 to be issued

the abscence in november was put down as abdominal pain but i took overdose, the abscence since feb was depression if this helps

atos can only advise that you are cover under the dda but a few in our office have since found out that depresion in most cases is not covered if your sholder injury was through work or a accedend on duty then you should not get a stage

Have you rang out royal mail helpline for depression and other issues that you may need help with, it would help with the depression as it will be a recognisation by royal mail that you would be getting help. i cant remember what it was called as i have now left IHR, but the service i got was good, and it thoroughly upset my manager when he was told about it in a stage interview and it also helped with my IHR. (depression because of manager harassment).

If you give them a bell, at least its on record and you may speak to someone who could help you more than royal mail or the union as these councilors are impartial and can give advice to both parties, in case of disputes

if atos considers he is suffering from depression and recognise that it falls within the remit of the equalities act 2010 (DDA DOES NOT EXSIST ANY MORE) then he has a protected characteristic status. he can have the stage interview and the absence recorded, but not issue the stage warning

only an employment tribunal can say for sure if he is covered under the equalities act but recomendation from the employers occupational health provider is enough.

you need to put in a grievance as to why the stage 2 was issued, i would also contact the

Equality and Human Rights Commission for advice

Surely you should be prep'ing half a walk, bundling half a walk and delivering half a walk, that's what I'd deem to be 50%!
